Problems and Obstacles of Inquiry Official On Performance Their Duties According to The Juvenile And Family Court Act and Judicial Examination and Determination B.E 2553 (2010): A Case Study of Mueang Sa Kaeo Provincial Police Station

Abstract

This research aimed to study problems and obstacles on duty performance of inquiry officials in Mueang Sa Kaeo Provincial Police Station according to the Juvenile and Family Court Act and Judicial Examination and Determination B.E. 2553 (2010), to bring about to duty performance in keeping with spirit of law and to perform their duties efficiently. It was a qualitative research by using in-depth interview as the research tool for obtaining data from 3 inquiry officials of Mueang Sa Kaeo Provincial Police Station who did their duties on investigation of juvenile.
The results revealed that; 1) For problem on arresting of juvenile delinquency, provisions of law were restricted and inflexible; while problem on classifying of juvenile offender was many of co-offenders, 2) For problem on investigation of arresting juvenile delinquency, it was found that age of juvenile and duration for bringing juvenile to investigate of arresting was too short, 3) For problem on investigation of juvenile delinquency related to determination on investigation place and qualifications of legal counsel, it was found that inquiry officials could not provide or difficult to find legal counsel for juvenile offenders. Therefore, some criteria shall be stipulated clearly in favor of duty performance for inquiry officials e.g. authority to make cautions in some cases, age of juvenile offenders while they were arrested, extension of time to investigate of arresting, investigation places and types of case needed to have legal counsel. These was to facilitate the duty performance of inquiry officials efficiently.
