PROBLEMS REGARDING COPYRIGHT OWNER OF ACADEMIC LITERARY WORKS SUBMITTED IN PARTIAL FULFILLMENT OF ACADEMIC REQUIREMENTS

Abstract

Legal issue regarding copy right owner of academic literary work submitted  in partial fulfillment of academic requirements  arises as a result of the rules and regulations of universities which specify that copyright is a thesis made part of education and crested by a student belongs to such university whereby such rules and regulations are not consistent with the principles of  copyright requirement by creature pursuant to the copyright Act, B.E. 2537 which is deemed to be unfair to students as creators of copyrighted work.

This research ,therefore, submits that copyright in a thesis made part of education should belong to a student as a creator of copyrighted work, and the rules and regulations of universities related to copyright in literary work made part of education should be amended to specify in literary work made part of education belongs to a student as a creator of copyrighted work and be revised to include provisions concerning methods and procedures of assigning copyright or licensing to use rights in literary work made part of education from students as owners of copyright to universities subject to students free will in order to avoid disputes or confusion in the ownership of copyright in literary work made part of education
