THE PROBLEM OF ROHINGYA’S RIGHT TO PROTECTION IN THAILAND

Abstract

This research was written 1) to study the problems about forcing immigration law in Rohingya smuggling of illegal migrants case including associated laws 2) to study ideas, theories and rules about protection Rohingya’s rights for forcing immigration law and others 3) to compare between International law, foreign law and Thai law about refugee’s rights to protection and Rohingya smuggling of illegal migrants and the last one is to study and suggest methods to solve these problems. This research was a quality research using documentary research approach for data collection.  And the final report of the research study to collect information.  The analyzed the conclusions for recommendations propose to do next.

What the researcher found is there are refugees in the sea that they should get helping as soon as possible caused being in need of four necessities of life and the climate has affected their safety.  To protect, threat and stop action for smuggling of illegal migrants including adding violence of penalty in human trafficking fault.

Therefore the researcher would like to suggest methods to solve these problems are make additional corrections law for rules to do in human rights to force Rohingya that should suit with committed International human rights law such as forcing law of the marines and send them off to birth country by the staff who has power, according to Immigration Act B.E. 2522.  To protect, threat and stop action for smuggling of illegal migrants including adding violence of penalty in human trafficking fault.  Including to make additional corrections law in section 62 especially prison sentence.
