THE PROPORTION PROBLEMS BELONG TO ASSIGN CRIMINAL OFFENSES AND PENALTIES IN ORDINARY PERSON DEFAMATION

Abstract

This research was written to study legal measures, theories and legal ideas about criminal offenses in defamation cases especially in ordinary person. And analyse legal problems about the proportion belongs to assign criminal offenses and penalties in ordinary person by focusing on advertisement defamation to offer methods to rectify good measures about proportion to assign criminal offenses and penalties  with  reducing  trouble  in  process  of  judgement  for  the  crime. This research was a quality research using documentary research approach for data collection. And the final report of the research study to collect information. The analyzed the conclusions for recommendations propose to do next.

The results mostly showed foreign laws don't use criminal law to force in defamation case and don't make laws to force in defamation cases that happen on internet, too. The 2nd  point  is  assigning criminal offenses and penalties in ordinary person defamation in Thailand  especially  criminal offenses in defamation on  criminal  code  and  in  Computer-related Crime Act B.E 2550  don’t tally.  Including  they  aren't suitable with guilts. And  the  last  point  is  to  assign  criminal offenses and penalties those are suitable with guilts and  reducing trouble in process of  judgement  for the crime therefore  we  should  have  criminal  offenses  especially  fine  including  compare cases to close cases in investigate  process  and reduce trouble  in  process of  judgement. 

The  author  suggested  the way to still keep penalties, however use only fine  with  giving  power  to  staff  in  the  criminal  procedure  code  more  than  before  tally  with  fine  in  new  law  on  defamation.
