LEGAL PROTECTION OF SAFETY WORKS IN PREGNANT NURSES : CASE STUDIES OF HOSPITALS UNDER THE MINISTRY OF PUBLIC HEALTH

Abstract

The most important aspect of this documentary study is the safety concern of pregnant nurses, who are working in the government hospitals under the Ministry of Public Health. As of the labour laws to make sure the protection of both mother and the fetus in Prenatal and Postnatal stages, that build up the amount of confidence in pregnant nurse workers in order to give the health service to public.

The outcome of the research set up the present enforcement to affect the Occupational Safety, Health and Environment Act B.E. 2554 (A.D. 2011),which is clear to be the standard to look after the job protection of nurses working in government hospitals. Though there is not specially state in the Act, the job guarantee for the pregnant nurses, who are working in the hospitals as public health service are in danger of their jobs. Additionally, the feature job of working pregnant nurses have 8 hours at every shift during 24 hours and night shift workers did not get enough rest which can be dangerous to baby inside the womb and could end up in abortion. Considering similarities between the International Labour Convention No. 183 on the safety of mother 2000 and the labour law from several countries located that it has identified the safety in particular of pregnant women however now not discriminatory of any career or any work either in government agencies or personal organization. Nevertheless in Thailand was observed that endorsement of one of these convention sanctions is not applied until now. The safety of pregnant women workers is below the enforcement using The Labour Protection Act B.E.2541 (1998). Although such regulation was no longer cover the protection of the women nurse during pregnancy who work in a government hospitals and so far does not have any precise law of the protection act.

Consequently, researcher proposed a prevalent principle of the International Labour Convention No. 183 at the safety of mother 2000 to apply, modify and add on The Labour Protection Act B.E.2541 (1998). To produce results and widen the coverage to pregnant nurse who works in the hospital within the public sector under the jurisdiction of the Ministry of Public Health. Or, on the other hand further amendment on the safety standard, occupational health and the working environment of the Ministry of Public Health by the Ministerial Regulations that enforcement in the protection of pregnant nurse who works in the hospital under the Ministry of public health, especially. In an effort to stick on to the principles of International Labour Convention No. 183 on the safety of mother, 2000 that could be a universal principle and to meet the international civilized countries.
