PROBLEMS OF ENFORCEMENT THE SECURITY GUARD BUSINESS ACT B.E. 2558

Abstract

In order to upgrade the standard of security business, to enhance the potential of security staff to benefit the users, and to help law enforcers work more effectively for the benefits of maintaining social order, there is a must to enact the Security Guard Business Act BE 2558. In contrast, after enforcing the Security Guard Business Act BE 2558, there are some significant problems arisen: 1) Problems regarding the qualifications of the security staff. 2) Problems with authority and role of security staff. 3) Problems with salary payment and overtime payment.

Therefore, it is important for the author to propose amendments to the Security Guard Business Act BE 2558 by imposing penalties on companies or business enterprises that violate the Security Guard Business Act BE 2558 by hiring employees to work in security positions. The penalty is 1,000 baht per day, but totally not more than 100,000 baht. Also, the act should be amended to allow security staff to carry firearms while they are on duty, but they must be properly trained in the use of firearms and must have a license. Moreover, the Labor Protection Act BE 2541, Section 65 (8), should be amended by issuing as a ministerial regulation to ensure that the security staff receive remuneration if they work overtime.
