LEGAL PROBLEMS RELATING TO THE RIGHTS AND BENEFITS FOR VOLUNTARY MEMBERS UNDER THE SOCIAL SECURITY ACT B.E. 2533

Abstract

The social security system is a system that shares benefits among its members. Generally, various governments concerns about people with income and those in the worker system before those with income outside of the system. A success of the social security is to provide the social security as the main security for people's lives. Hence, they can live happily if they face financial problems.

There are two types of the insurers according to Thailand's social security laws: regulated and voluntary insurers. Both types of the insurers must pay for expenses by themselves.

By studying the problems, rights and benefits of the voluntary insurers, it was found that they did not have enough rights and benefits in the cases of the lack of income and child support. Thus, new laws and regulations about additional rights and benefits for them are necessary in order to promote fairness.

It is suggested by the author to amend the social security law regarding the rights and benefits of the voluntary insurers. The current law specified only four cases of the rights and benefits. The rights and benefits must fair according to laws by amending the announcements of the Social Security Office regarding child support and compensation for the loss of income in order to provide options according to their abilities and fairness meeting the purpose of the social security and making the social security law equivalent to civilized countries.
